These terms apply to every order placed on this site. They are a contract between your business and VisionGuard Services, the trade name of a sole trader (see the Legal notice). They are written in plain language on purpose: if anything is unclear, ask us before you buy.
Businesses only
We sell only to businesses and professionals buying for their business. At checkout you confirm this and give the name of the business. We do not accept orders from consumers: if you are buying for personal use, please do not order. Consumer rules for distance sales therefore do not apply to our contracts; the refund policy below applies instead.
What you buy
Each service has its own page listing what it includes, what each plan size adds, its monthly allowance, the extras you can add and every price. That page as it stood when you ordered, together with your order confirmation, defines what you bought. Nothing on this site is an open-ended engagement.
How a build works
You pay, then answer a short questionnaire about your business: what you sell, who to, your style and your goals.
We prepare five sample concepts from your answers.
You choose one or mix them, and send your own material: logo, photos, texts, prices.
We build the final version from the concept you chose and your material, check it automatically and deliver it to your dashboard.
Your order includes revision rounds for changes and fixes; you request them from the order page.
If you do not answer the questionnaire, building starts 6 hours after payment with what we have, and your dashboard shows it. Delays caused by missing answers or material are not delays on our side.
What we need from you
Accurate information about your business, and answers and material in reasonable time.
Only lawful content, and the rights to everything you send us (logos, photos, texts, data, customer lists). You are responsible for having permission to use it, and you will cover us against third-party claims caused by material you provided.
You check what we deliver before you publish it, and you are responsible for what you publish, including whether its claims are true of your business and meet the rules of your sector and country.
When a service handles personal data of your own customers, you are responsible for having a lawful basis to collect it and for informing them in your own privacy notice.
Acceptable use
You may not use our services, or what we deliver, to:
break the law, or infringe anyone's intellectual property, privacy or other rights;
send spam or unsolicited messages, or deceive people (fake reviews, impersonation, misleading claims);
spread malware, attack or probe systems, or get around our usage limits or security;
publish hateful, violent, sexual or harassing content, or any content involving minors;
give medical, legal, tax or financial advice, make credit or hiring decisions, identify people biometrically, or carry out any other regulated activity;
resell our tools or give third parties access to them as if they were your own service, unless your plan says you may.
Who owns what
Your material stays yours. You allow us to use it only to deliver and run your order.
One-off jobs: once paid in full, the work we create for you (texts, designs, the site and its files) is yours to use and change, and stays yours forever.
Plans: you may use everything we build and run for you while your plan is active. When it ends, the files already delivered to your dashboard stay yours; what we run for you (hosting, AI usage, the assistant, monitoring) stops at the end of the paid period.
We keep our own tools, templates, code libraries and methods, which we reuse across customers; you may use them as part of what we deliver. Third-party parts (fonts, open-source code, licensed images) stay under their own licences. We do not resell your specific work to anyone else.
Prices and payment
Prices are shown in US dollars before you buy. We do not add VAT or any other tax to them: as a business buyer, you account for any tax due on the purchase in your own country.
Payment is taken by our payment provider (Stripe, with Lemon Squeezy or bank transfer as alternatives). Plans renew automatically at the end of each paid period (monthly, every 3 months or yearly, as you chose) until you cancel from your dashboard.
Usage beyond your plan's allowance, and extras, are charged only at the rates shown on the service page before you buy.
Cancellations and refunds
Cancellations and refunds follow our Refunds & cancellation policy, which is part of these terms. In short: a full refund before work starts; after that, no refund for stages delivered; plans can be cancelled at any time and run to the end of the paid period.
Suspension and termination
If a payment fails or is reversed, we tell you and pause the service until it is settled.
If you break these terms or the acceptable use rules, or open a chargeback without contacting us first, we may suspend the service concerned immediately and, for serious or repeated breaches, close the account.
We may decline or end an order we cannot deliver honestly; we then refund what has not been delivered and tell you why.
No guarantee of business results
We guarantee that what we deliver contains what the service page lists. We do not guarantee business results: sales, traffic, rankings, conversions, leads or savings depend on your market, your offer and many things outside our control, and nothing we say is a promise of them.
Liability
Our total liability for any claim relating to our services is limited to the fees you paid us in the three months before the event that caused the claim. We are not liable for indirect or consequential loss, including lost profit, revenue, data or goodwill. Keep your own copies of what we deliver. Nothing in these terms limits liability for fraud, wilful misconduct or anything else that the law does not allow to be limited.
Personal data
How we handle your personal data is explained in our Privacy policy.
When a service processes personal data of your customers on your behalf, we act as your processor: we process it only to deliver that service on your instructions (these terms and your order), keep it confidential, use only the sub-processors listed in the privacy policy, help you answer requests from the people concerned, tell you without undue delay about any breach affecting it, and delete it when the service ends unless the law requires us to keep it.
Changes to these terms
A one-off job stays under the terms in force when you ordered it. For plans, we tell you about changes at least 30 days before they apply; if you do not agree, you can cancel before then.
Law and disputes
These terms are governed by the law of the country where VisionGuard Services is established, and any dispute will be heard by the competent courts of that country. Before that, write to hello@visionguardservices.online: most problems are solved with one message.
